The Federal Constitutional Court has overturned parts of the Inheritance Tax Act
Certainty has now prevailed since 17.12.2014. Karlsruhe has decided that the exceptions for corporate assets under inheritance tax law are not consistent with the Constitution. At the same time, however, the court has confirmed that exceptions for small and medium-sized companies are within the law. The legislator has been called on to make amendments and has now been given until 30.06.2016 to find a new ruling. The existing regulations will remain applicable in the interim period. A problem is, however, that these new rulings can apply retrospectively as from 17.12.2014.
